Military Critical Technical Data Agreement (DD Form 2345)

The U.S. Department of Defense requires certification from U.S. contractors, including universities, that wish to obtain access to unclassified technical data that discloses specifications for technology considered critical by the U.S. Department of Defense and/or Canadian Department of National Defense. Unclassified technical data may require an approval authorization or license under U.S. or Canadian export control laws. Approval is also required to share any unclassified technical data with any foreign nationals in the U.S. Contact Mike Sanderson with questions.

The University of Colorado Colorado Springs certification is principally used to facilitate either the exchange of export controlled technical data between defense contractors (i.e., between prime contractor and subcontractor) or the participation of University researchers in DoD/DND sponsored events (e.g., to discuss program requirements or present research findings).


Note: University faculty, staff, trainees, and students engaging in University supported activities are required by the Joint Certification Program (JCP) to use our institutional certification rather than register as an individual.


Given that the purpose of the JCP is to facilitate the exchange of export controlled technical data, OSPRI is responsible for administering the University's certification under the oversight of Data Custodian. The Office of Sponsored Programs and Research Integrity maintains an approved Military Critical Technical Agreement (Form DD2345) with the JCP.

Process

 

UCCS’s Export Control Officer, an empowered official, serves as Data Custodian for UCCS’s DD2345 form. Under the JCP, data is sent to the recipient's Data Custodian named on the DD2345. The Data Custodian is then responsible for ensuring that appropriate safeguards (controls) are put in place to prevent unauthorized disclosures and exports before releasing it to the end user (i.e., researcher).

Faculty, staff and students who require access to this information must complete and submit a request form (PDF) for approval. Email the completed DD2345 form and other required documents to the UCCS Data Custodian at exportcontrol@uccs.edu. Additional requirements may include the implementation of a Technology Control Plan (TCP) and Export Control training.
